Terms and Conditions of the Online Store with Electronic Services

I. General Provisions Definitions

  • Store – an online store available at www.gameonkite.com.
  • Electronic Services – electronic services provided by the Store.
  • Seller – Game on Kiteboarding Karolina Winkowska, located at Mickiewicza 37 m.25, 01-625 Warsaw, NIP 5252374961.
  • Customer – an individual or legal entity using the Electronic Services of the Store.

II. Rules for Providing Electronic Services Registration

  • Some Electronic Services may require registration.
  • The Customer undertakes to provide true and current data during the registration process. 

Availability of Services - The Seller undertakes to provide Electronic Services with due diligence and in accordance with applicable law.

III. Payments and Invoices Prices

  • All prices provided in the Store are gross prices in Euro (including VAT).
  • Payment terms are determined individually for each Electronic Service. 

Payments - The Customer can make payments via bank transfer, credit card, or other available payment methods.

  • The payment deadline is determined individually for each Electronic Service. 

Invoices - The Customer will receive an electronic invoice for using paid Electronic Services.

  • The invoice is accessible in the Customer's panel.

IV. Liability and Complaints Liability

  • The Seller is not liable for damages resulting from improper use of Electronic Services by the Customer. 

Complaints:

  • The Customer has the right to file a complaint in case of improper provision of Electronic Services.
  • Complaints should be submitted electronically to karolina@gameonkite.com
  • The Seller undertakes to consider complaints within 14 working days.

Return product:

Consumer, may return product within 14 calendar days without giving any reason and without incurring costs, with the exception of the costs indicated below, in accordance with the Consumer Rights Act of May 30, 2014 (Journal of Laws of 2014, item 827, as amended)."

V. Personal Data Protection Privacy Policy

  • The Store complies with the principles of personal data protection.
  • Customer's personal data is used only for purposes related to the provision of Electronic Services.

VI. Final Provisions Changes to the Terms and Conditions

  • The Seller reserves the right to make changes to the terms and conditions.
  • Changes come into effect upon their publication on the Store's website. 

Dispute Resolution - Any disputes arising from the agreement to provide Electronic Services will be settled by the court having jurisdiction over the Seller's registered office.

These terms and conditions are effective from 3.12.2023.

Online Sports Classes Regulations

1. General Principles:

  • Participants engage in online classes at their own risk.
  • The instructor is not responsible for any injuries, injuries, or material losses incurred in connection with participation in the classes.

2. Preparation of Space:

  • Participants are responsible for appropriately preparing the exercise space, eliminating potential hazards and obstacles.
  • Ensure that the exercise area is free from obstacles that could cause injury.

3. Health Condition:

  • The participant confirms that they are in a sufficiently good state of health to actively participate in the classes.
  • In case of doubts about their health condition, it is recommended to consult with a doctor before joining the classes.

4. Self-discipline:

  • Participants commit to following the instructor's recommendations and adjusting the intensity of exercises to their skill level.
  • Avoid exceeding personal capabilities in a way that could lead to injury.

5. Technical Safety:

  • Participants are responsible for maintaining a secure internet connection and computer equipment.
  • The instructor is not responsible for technical issues that may affect the quality of participation.

6. Consent to Image Sharing:

  • Participants agree that during classes, they may be visible to other participants unless they choose to disable their camera.
  • The participant's image may be used for promotional and marketing purposes by the instructor.

7. Consent to Conditions:

  • Participants, by joining the classes, accept the conditions of the responsibility regulations.

The above regulations aim to establish responsibility guidelines for participation in online sports classes on the Zoom platform. We encourage compliance with the outlined instructions to ensure safe and effective physical activity.
